Terms of Service

This is the agreement between Build Season and the parent or legal guardian who enrolls a student. Please read it before you enroll.

These Terms are a contract between Build Season, operated by Build Season, LLC (“Build Season,” “we,” “us”), and the parent or legal guardianwho creates the account and enrolls a student (“you”). By enrolling, you agree to these Terms on your own behalf and on behalf of the student you enroll.

1. You are the contracting party

The student does not enter into this contract. You, the parent or legal guardian, are solely responsible under these Terms. You confirm that you are at least 18 years old, that you are the parent or legal guardian of the student, and that you have the authority to agree on the student’s behalf.

2. Who can enroll (United States, ages 11–17)

Build Season is available to families located in the United States only. Students must be between 11 and 17 years old. The program is not offered to adults as participants and is not available outside the United States.

3. This is education — not an income program

Build Season is an educational program. It teaches students to build real projects and to run a small, parent-supervised venture as a way to learn. It is not a job, not a business opportunity, and not an income program. We do not promise, project, or guarantee any earnings. We do not provide customers, sales outlets, or buy-backs. Any money a student makes comes entirely from the student’s own parent-supervised projects, and depends on the student’s effort, ideas, and market.

4. Your responsibilities as the parent

You agree to:

  • Supervise the student’s venture. You oversee what your student builds, offers, and sells, and you are responsible for it.
  • Own and control every account used to sell or get paid. Any selling or payment account (for example a payment link, an online shop, or a payout account) must be opened, owned, and controlled by you. You are the Merchant of Record for everything your student sells. Money flows to you, never through Build Season.
  • Make sure the student’s activities follow the rules of any outside platform you use, and all applicable laws.
  • Provide the supervision and approvals the program asks of you.

Build Season never processes, holds, or routes student venture money, and never contacts customers on a student’s behalf. We are not a party to any sale your student makes and are not responsible for those transactions.

5. Who owns what the student creates

The student owns the work they createin the program — their projects, brand, and artifacts. We claim no ownership of it.

You grant us a limited, non-exclusive license to display the student’s work inside the program (for example, in the Showcase) and to operate the program. This license does not let us use the student’s work in public marketing or advertising. We will only use a student’s work or likeness publicly with your separate, specific written permission, and we never publish a student’s face or full name. This display license ends when we delete the work under our retention schedule or when you ask us to remove it.

6. About Coach, our AI study tool

The program includes Coach, an AI study tool. Coach is not a personand is labeled as AI throughout. AI can be wrong, incomplete, or out of date. Coach is a study aid, not professional advice of any kind — not legal, financial, medical, or mental-health advice. Do not rely on Coach as a substitute for a qualified professional, and always use your own judgment. Our Safety page explains how Coach is scoped and supervised.

7. Acceptable use and safety termination

The student must use the program for its intended educational purpose. Prohibited conduct includes attempting to misuse or jailbreak the AI, harassing others, sharing personal contact information, posting unsafe or unlawful content, or trying to access another family’s data. We may suspend or terminate access to protect a student’s safety, the safety of others, or the integrity of the program. Where safety allows, we will tell you why. A termination for cause does not entitle you to a refund beyond what the refund policy below provides.

8. Refunds and guarantees

You are protected two ways:

  • 14-day money-back guarantee. For any reason at all, you can request a full refund within 14 days of purchase, as long as your student has completed no more than 2 lessons. It’s a window to try the start — not to finish the course and then ask for your money back.
  • Continuity pledge. If we discontinue the program, every family with active access receives a full refund.

To request a refund, email hello@buildseason.camp. Your separate right to review, delete, or withdraw consent for your child’s data is always available from your Parent Dashboard and is not limited to the refund window (see our Privacy Policy).

9. Access

The program is self-paced: your student starts as soon as you enroll and works through it at their own pace, with each lesson unlocking the next. There are no cohorts, fixed start dates, or transfers to manage.

10. Limitation of liability

To the fullest extent permitted by law, Build Season is provided “as is.” We are not liable for indirect, incidental, special, or consequential damages, or for any outcome of a student’s venture, including any sale, customer interaction, or earnings (or lack of earnings). Our total liability to you for any claim relating to the program will not exceed the amount you paid us for the enrollment giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. You and Build Season agree to try to resolve any dispute informally first by contacting hello@buildseason.camp. Either party may always bring an individual claim in small-claims court if it qualifies.

12. Changes to these Terms

We may update these Terms. If a change is material, we will notify parents. The “last updated” date above always reflects the current version. Continued use after a change means you accept the updated Terms.
